public Notices Winthrop News Wednesday, March 31, 2OlO Legal Notices Page lO Industrial Drive Improvements Notice of Hearing on Proposed Assessment TO WHOM IT MAY CONCERN: Notice is hereby given that the council will meet at 7:10 p.m. on April 5, 2010 in the council chambers at city hall, 305 North Main Street, Winthrop, Minnesota to consider, and possibly adopt, the proposed assessment for improvement No. 09-11904, the con- struction of Industrial Drive (west) and associated utility extensions and tum lanes on Trunk Highway 19, and the improvement of the existing Industrial Drive (east). Adoption by the council of the proposed assessment may occur at the hearing. The proper- ties proposed to be assessed are those properties abutting Industrial Drive. Such assessment is"proposed to be payable in equal annual installments including principal and interest extending over a period of 15 years, .the first of the installments to be payable on or before the first Monday in January, 2011, and will bear interest at the rate of 6.0 percent per annum from the date of the adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution un'til December 31, 2009. To each subse- quent installment when due shall be added interest for one year on all unpaid installments. You may at any time prior to cer- tification of the assessment to the county auditor, pay the entire assess- ment on such property, with interest accrued to the date of payment, to the city clerk. No interest shall be cl:larged if the entire assessment is paid within 30 days from the adoption of this assessment. You may at any time thereafter, pay to the county auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 6.0 percent per year. The right to partially prepay the assess- ment according to city ordinance is available. v The proposed assessment roll is on file for public inspection at the city clerk's office. The total amount of the proposed assessment is $468,700.00. Written or oral objections will be con- sidered at the meeting. No appeal to district court may be taken as to the amount of an assessment unless a writ- ten objection signed by the affected property owner is filed with the municipal clerk prior to the assess- ment hearing or presented to the pre- siding officer at the hearing. The council may upon such notice consider any objection to the amount of a pro- posed individual assessme.nt at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. Under Minn. Stat. 435.193 to 435.195 and city code Chapter 302.08, the council may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to make the payments. When deferment of the special assessment has been granted and is terminated for any reason provided in that law and city code, all amounts accumulated plus applicable interest become due. Any assessed property owner meeting the requirements of this law and city code chapter 302.08, may, within 30 days of the confirmation of the assess- ment, apply to the city clerk for the prescribed form for such deferral of payment of this special assessment on his/her property. An owner may appeal an assess- ment to district court pursuant to Minn. StaI. 429.081 by serving notice of the appeal upon the mayor or clerk of the city within 30 days after the adoption of the assessment and fil- ing such notice with the district court within ten days after service upon the mayor or clerk. Jenny Hazelton City .Clerk 22-23W(af)e NOTICE City of Winthrop , Dog License Ordinance Enforcement Dog owners within the City of Winthrop are required under Ordinance 503.03 to purchase a dog license by January I st of each year. In 2009 the council amended the ordinance to have dog owners also provide proof of liability insurance in the minimum amount of $50,000. If you own and insure your home you most likely already have liabiiity insurance. If you rent your home or an apartment you will need to obtafn renters liability insurance. If you are uncertain you should contact your insurance agent. Ill addition, owners must provide proof that dog(s) to be licensed have been vaccinated against rabies. The cost of licenses for male or females dogs is $10. Under the ordinance, dogs'are not allowed to run at large in the city. Police officers will impound any dog found unlicensed or running at large and will give notice of the impounding to the owner if known. If the owner is unknown, the officer will post notice of the impounding on the bulletin board in the front entrance at Winthrop City Hall. If the dog is not claimcd within five regular business days of the posting of the notice, it will be destroyed. An impounding fee of $10 and a charge of $2 per day for feeding shall be charged for any dog held at the pound. It is unlawful for any person who owns or has control of a dog to cause or permit such animal to defecate on any private property without the con- sent of the property owner or on any public property, unless such person immediately removes the excrement and places it in a proper receptacle. Failure to comply with the provi- sions of this ordinance could result in a citation issued to the dog's owner by the Winthrop Police Department and a $25 fine.
